Purpose
These Terms govern the rights, obligations, and responsibilities between the Company and Members and aim to provide a safe and reliable Service.
Definitions
Company:EmOcean AI. Member:A person who agrees to these Terms and uses the Service. Paid Services:Fee-based offerings such as EmOcean Vibe Pro and EmOcean Vibe Business/Enterprise. Content:Data, text, images, and other materials provided by the Service or created by Members.
Effect & Modification
These Terms take effect upon posting within the Service or by other notices. The Company may amend these Terms within the scope of applicable laws. Changes take effect 7 days after notice; 30 days for materially adverse changes.
Use of Services
Members must comply with these Terms and applicable laws. The Service is provided 24/7 in principle, but may be suspended for maintenance, security, or operational reasons with prior or follow-up notice. The Company may analyze/use de-identified datafor quality and security per the Privacy Policy.
Paid Services & Payment
Paid Services are provided at posted prices; Members must review pricing and refund terms before purchase. Payments are processed via methods designated by the Company. Refunds:Full refund if no usage within 7 days after purchase; otherwise limited per policy unless due to Company fault.
Privacy Protection
The Company complies with applicable laws, including GDPR and CCPA/CPRA, and details processing purposes, retention, and cross-border transfers in the Privacy Policy.
Member Responsibilities
Members shall provide accurate information; no account theft, false information, or Service interference (e.g., hacking, malware). Content in the Service may not be copied, distributed, or commercially used without prior written consent.
Company Rights & Duties
The Company endeavors to provide stable Services and may restrict or terminate accounts for violations of laws or these Terms. The Company may use de-identified data for improvement and research under data-minimization principles.
Disclaimer & Limitation
The Company is not liable for outages caused by force majeure or reasons not attributable to it. Members are responsible for issues arising from their intent or negligence. Information and test results are for reference only and do not constitute medical diagnosis or treatment.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, USA. Any dispute shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
Supplementary
Effective 2025-11-01. In case of discrepancies among translations, the English version shall prevail.
